    1. Introduction

    This document outlines the terms and conditions ("Terms") for using PAMSHub ("the Service"), a service operated by Kerrendan No.49 Pty Ltd. By accessing or using the Service, you agree to comply with these Terms. If you do not agree, you must not use the Service.

    2. Eligibility

    You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into this agreement.

    3.Account Registration

    To access certain features of the Service, you may be required to create an account. You agree to provide accurate and complete information during the registration process and keep this information updated. You are responsible for maintaining the confidentiality of your account and password.

    4. User Conduct

    You agree not to use the Service for any illegal or unauthorized purpose. 

    This includes: 

      • Harassing, threatening, or abusing others.
      • Impersonating any person or entity.
      • Violating any local, state, national, or international laws.
      • Uploading harmful or malicious content, such as viruses.

    5. Payments and Fees

    Some features of the Service may require payment. By selecting a paid feature, you agree to pay all applicable fees. Payments are non-refundable unless otherwise stated. We reserve the right to modify our fees at any time with reasonable notice.

    6. Subscription Services

    If the Service offers subscriptions, you agree to pay any subscription fees associated with your account. Unless otherwise stated, subscriptions renew automatically. You can cancel your subscription anytime, but you will not receive a refund for any pre-paid period. 

    7. Termination

    We reserve the right to suspend or terminate your account or access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or harms other users or our business.

    8. Privacy

    Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you agree to the collection and use of your information as outlined in the Privacy Policy. 

    9. Limitation of Liability

    9.1 To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service, even if we have been advised of the possibility of such damages.

    9.2 PAMSHub is not responsible for the reconstruction of lost data beyond what is necessary for the operation of its services.

    9.3 PAMSHub will not be held liable for service interruptions beyond its control, including, but not limited to, natural disasters, disruptions caused by its service providers, or modifications made to the client's system by the client or third parties.

    9.4 PAMSHub does not monitor or regulate the content or data passing through or temporarily stored on its system, except under Court order or in cases where reasonable suspicion of legal violations exists.

    9.5 PAMSHub reserves the right to discontinue all or any portion of the provided services at any time for any reason, upon providing notice to the client.

    9.6 PAMSHub will make reasonable efforts to respond to support requests; however, technical support is not guaranteed under the terms of this agreement.

    10. Dispute Resolution

    Any disputes arising out of or relating to these Terms or the Service will be resolved by binding arbitration in accordance with the rules of [Arbitration Organization], unless both parties agree otherwise. You waive the right to bring any claims in court. 

    11. Changes to the Terms

    Any notices required under this Agreement must be in writing and will be considered sufficiently served if sent by registered letter or email, addressed to the respective parties at the addresses provided above or any updated address notified by either party. 

    We reserve the right to modify the terms and conditions of this Agreement at any time. The latest version of our terms and conditions is available on our website at https://pamshub.au/terms-and-conditions.

    12. Governing Law

    These Terms are governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law principles.

    Terms and Conditions for $100 Credit Offer 

    1. Eligibility:
      • This offer is available to new users who successfully create a PAMSHub account.
      • The $100 credit is limited to one per new account and cannot be transferred or shared.
    2. Offer Validity:
      • The $100 credit will be applied automatically upon successful account creation.
      • The credit must be used within 30 days from the date of account creation.
    3. Usage of Credit:
      • The credit only applied towards 1 client hub on PAMSHub.
      • The credit cannot be exchanged for cash or used in conjunction with other promotions unless stated otherwise.
    4. Account Requirements:
      • Users must provide accurate and complete registration information to qualify for the credit.
      • Duplicate or fraudulent accounts will be disqualified from receiving the credit.
    5. Cancellation or Modification:
      • PAMSHub reserves the right to modify or cancel this offer at any time without prior notice.
      • Any misuse of the offer may result in the suspension of the credit or account termination.
    6. Restrictions:
      • This offer is not valid for existing PAMSHub users. 
      • Credits cannot be applied to shipping fees or taxes unless specified. 
    7. Dispute Resolution:
      • Any disputes related to this offer will be governed by the laws applicable to PAMSHub's terms of service.
